PYTI Intellectual Property Policy
PROFESSIONAL YOGA THERAPY INSTITUTE POLICY REGARDING USE OF INTELLECTUAL PROPERTY
As a participant in the Professional Yoga Therapy InstituteTM (“PYTI”) Certification program, you will be, or have already been provided access to numerous resources, including, but not limited to PYTI program course materials, processes and programming.
Please note that any materials that you receive from, or that are presented at any PYTI module, class or training, including, but not limited to, written materials, processes, programming, presentations, graphics, illustrations, charts, graphs, and digital media, whether presented as hard copies or electronically, as well as the PYTI name and mark are the intellectual property (“Intellectual Property”) of Ginger Garner and/or PYTI and that Ginger Garner and/or PYTI own any and all copyrights and other rights regarding the same. Such copyrights and other rights also extend to any Intellectual Property that may be obtained via the internet or any other third party.
Any individual or entity desiring to use all or part of the Intellectual Property in any capacity that is not for private use or for use in clinical practice, must first obtain the written consent of PYTI, which consent PYTI may grant or withhold in PYTI’s sole discretion. This policy applies to both verbatim use of the Intellectual Property as well as any use of materials that are substantially similar to the Intellectual Property. Any use of the Intellectual Property or any part thereof must be properly cited at all times and at every instance of use. PYTI will require individuals and entities who have been approved to use part or all of the Intellectual Property to display the PYTI name and mark pursuant to such specifications as PYTI may set forth from time to time.
PYTI may, at its sole discretion, grant licenses to a limited number of individuals to use the Intellectual Property to provide Professional Yoga Therapy Certification program instruction and other continuing education programs and/or license the Intellectual Property for more limited purposes.
In the event that all or part of the Intellectual Property is used in the absence of PYTI’s written consent and/or a formal licensing agreement and such use violates state and/or federal copyright laws and/or other applicable intellectual property laws, regardless of whether such Intellectual Property is properly cited, PYTI will take all necessary action to protect any and all rights it has in the Intellectual Property and will also seek to recover any and all attorney’s fees and costs that it incurs in the course of enforcing its rights.
